Clock Motorcycle
Got hurt on work property but not on the clock, do they pay or do I?
I broke my wrist in the parking lot at work. I was on lunch and clocked out. What happened was I was leaving on my motorcycle when a man pulled into the parking lot. There is a HUGE pothole with alot of gravel around it and I stopped to let the car pass, but my foot slipped on the gravel and I went down. I am more than prepared to deal with this myself, I was just wondering because I am being told to fight the fact that they don’t want to pay. PLEASE HELP
FYI, I can control my bike, but in loose gravel anyone would have a problem with it . Don’t be such an a**

If the company you work for owns the land on which the incident occurred then they are liable as they have a duty of care to provide you with a safe working environment.
If they deny responsibility remind them that as the pothole was covered with gravel you are in no doubt that they are and have been aware of it. As such, they must assume liability as they did not take sufficient measures to guard against the possibility (which they must have contemplated as they tried to bodge it) that an injury may occur in light of it.
You have a strong case, seek legal advice immeiately as you have six months from the date of the incident to action it.
